Terms of Service — Serendipity

Agreement to Terms

By accessing or using Serendipity (the "Service") operated by Serendipity Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Description of Service

Serendipity is a life-path discovery platform that identifies shared historical moments (overlaps) between users, enabling meaningful connections. Core features include:

Life event and location import and management
Overlap detection and connection discovery
A social feed for sharing places and moments
QR-based and username-based connection
API access for business clients (governed by separate API Terms)

Eligibility

You must be at least 16 years old to use this Service. By using Serendipity, you represent and warrant that you meet this requirement.

Accounts

Registration. You must create an account to use most features. You agree to provide accurate information and keep it current.

Security. You are responsible for maintaining the confidentiality of your credentials. Notify us immediately at [email protected] if you suspect unauthorized access.

One account per person. Creating multiple accounts to circumvent bans or other restrictions is prohibited.

Acceptable Use

You agree not to:

Upload or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
Impersonate any person or entity.
Use the Service to collect or harvest personal data about other users without their consent.
Attempt to reverse-engineer, decompile, or derive source code from the Service.
Use automated bots, scrapers, or other means to access the Service without our written permission (except via the authorized API with a valid key).
Circumvent any access controls or security measures.
Use the Service for any unlawful purpose or in violation of applicable regulations, including GDPR, CCPA, or CAN-SPAM.

User Content

Ownership. You retain all rights to content you create on Serendipity (posts, photos, captions).

License to us. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and store that content solely for the purpose of providing and improving the Service. This license terminates when you delete the content or your account.

Responsibility. You are solely responsible for content you post. We are not liable for user-generated content.

Removal. We reserve the right to remove any content that violates these Terms or that we deem harmful to the community, without prior notice.

Location Data and Overlaps

By importing location history or photo metadata, you consent to:

Storage of GPS coordinates and timestamps associated with your account.
Use of that data to compute overlap scores with other users you connect with.
Display of overlap summaries (place name, approximate date, score) to your connected users.

We do not share raw coordinate data with other users or third parties.

API Terms

If you access the Service via the Serendipity Engine API:

You must obtain a valid API key via the official request process.
You may not resell API access or use it to build competing services.
You are responsible for all activity under your API key.
We may rate-limit, suspend, or terminate API access at any time.
API responses may only be used for purposes disclosed in your access request.

Intellectual Property

The Service, including all software, design, logos, and content created by us, is owned by Serendipity Inc. and protected by applicable intellectual property laws. You may not copy, modify, or distribute our proprietary content without written permission.

Privacy

Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you consent to the practices described therein.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SERENDIPITY INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless Serendipity Inc. and its affiliates from any claims, liabilities, damages, and expenses (including attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.

Termination

We may suspend or terminate your account at any time for violations of these Terms, with or without notice. You may delete your account at any time from your profile settings. Upon termination, your license to use the Service immediately ends.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.

Changes to Terms

We may modify these Terms at any time. We will provide at least 14 days' notice for material changes, via email or in-app notification. Continued use after the effective date constitutes acceptance of the new Terms.
